EU Data Act - New data sharing obligations

Last year, we published a series of articles on the EU Data Act (the "Data Act"). The Data Act is a comprehensive piece of legislation aimed at fostering a fair and competitive digital environment in the European Union. It focuses on ensuring that data (both personal and non-personal) is shared more effectively, while protecting the rights of individuals and businesses.
Whilst the Data Act entered into force on 11 January 2024, it only became applicable today, Friday 12 September 2025.
The Data Act applies to companies (whether or not based in the EU) that operate and manage connected products and/or related services in the EU. It includes new, harmonised rules governing data access and sharing for connected devices and related services, and contains rules which affect the provision of cloud services, including rules governing contracts for these services.
